These Terms of Service ("Terms") govern your use of achillesneurology.com (the "website"), operated by Achillefs Ntranos MD, P.C., doing business as Achilles Neurology Clinic ("we", "us", "our"). By using the website, or by ticking the box on one of our forms, you agree to these Terms. If you do not agree, please do not use the website.

These Terms cover the website only. The medical care you receive from us is governed by the agreements and consent forms you sign with the practice and by applicable law. Submitting the booking form is a request, not an appointment, until our office confirms it with you. Telehealth visits require you to be physically in California at the time of the visit, and consent for telehealth is obtained at the visit, as California law requires.

Medical disclaimer

The information on this website is provided for general information and education. It is not medical advice and should not be relied upon as a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of your physician or another qualified health provider with any question about a medical condition, and never disregard professional advice or delay seeking it because of something you read here. Using this website does not create a doctor-patient relationship. If you think you may have a medical emergency, call 911 immediately.

Health information and privacy

Information you give us to request or receive care is protected by HIPAA and the California Confidentiality of Medical Information Act. Our Privacy Policy describes what this website collects, who receives it and the choices you have, and our Notice of Privacy Practices explains how we use and protect your health information. The Privacy Policy is a notice, not part of this contract, and nothing in these Terms waives any right you have under California privacy law.

Use of the website

The content of this website belongs to Achilles Neurology Clinic or its licensors and is protected by copyright and other laws. You may view and use it for personal, non-commercial purposes. You may not copy, modify, distribute or commercially use it, remove any proprietary notice, or mirror it on another server without our written permission. You agree not to interfere with the website or its security, including by attempting unauthorized access, submitting malicious code, scraping the website at volume, or submitting false appointment requests, messages or reviews. We may suspend or end your access to the website if you violate these Terms.

We may contact you by phone, email and text message about appointments, care coordination, results, insurance and billing; some messages are sent by automated systems. Our booking and contact forms require your agreement to text messages, given in a separate box. The Privacy Policy describes what we text, and you can opt out at any time by replying STOP. Email and text messages can be intercepted or misdirected and are not completely secure, so use them for non-urgent matters only; in an emergency, call 911. Calls with our office may be recorded and transcribed for quality and training; we say so at the start of the call, and you may ask us not to record.

Disclaimers and limitation of liability

The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, and we are not responsible for the content, privacy practices or availability of third-party sites linked from or embedded in the website, including Google Maps. To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential or punitive damages arising from your use of the website. Nothing in these Terms limits liability that the law does not allow us to limit, including liability for professional medical services, fraud, willful injury or violation of law.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.

This section contains a binding arbitration provision and a class action waiver. Any dispute, claim or controversy arising out of or relating to these Terms or your use of the website shall be resolved exclusively by binding arbitration on an individual basis, conducted in Los Angeles, California, under the rules of the American Arbitration Association and governed by the Federal Arbitration Act. Judgment on the award may be entered in any court of competent jurisdiction. You agree not to participate in any class, consolidated or representative action against us relating to the website. Either party may seek injunctive or equitable relief in court for matters such as intellectual property infringement or unauthorized access to our systems. This section does not apply to claims arising from medical care or professional services, which are governed by your patient agreements and applicable law, and it does not waive any right that cannot be waived under California law, including rights under California privacy laws. You may opt out of this arbitration provision by emailing info@achillesneurology.com within 30 days of your first use of the website.

Reviews and other content you submit

You are responsible for what you submit through the website, and you confirm that it is accurate and that you have the right to submit it. If you submit a review and tick the box allowing publication, you grant us a non-exclusive, royalty-free license to publish it on this website with your initials and to edit it for length, privacy or clarity without changing its meaning. You may withdraw that permission at any time by contacting us, and we will remove the review. We check submissions for privacy and spam before publishing. Do not include other people's personal information.

Accessibility

We want everyone to be able to use this website and aim to meet WCAG 2.1 Level AA. If any part of it is hard for you to use, call (310) 774-7025 or email info@achillesneurology.com, and we will help you book or get the information another way.

Changes and general terms

We may change these Terms, and we may change, suspend or discontinue any part of the website, at any time. The date at the top shows the current version, and we describe material changes on this page. Continued use of the website after a change takes effect means you accept the changed Terms; changes do not affect a request you already made. If any provision of these Terms is found unenforceable, the rest remain in effect, and our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and Achilles Neurology Clinic about your use of the website.
